International Arbitration: East Meets West

Attempting to explore differences between the East and the West in international arbitration, this talk considered the impact of cultural nuances and legal traditions on arbitration proceedings. Through the sharing of first-hand experience and interactive discussion, it covered a variety of practical issues, ranging from interaction with clients to interpretation of context, from negotiation tactics to questioning and cross-examination strategies, from disclosure of evidence to enforcement of arbitral awards, etc. In addition to examining culture and legal tradition, the discussion also touched on some characteristic merits of arbitration proceedings in China as well as harmonisation of rules and practices. This evening talk featured a panel of seasoned practitioners including Ms Alice Wang (Executive Committee Member of Women in Arbitration) as the moderator, and three speakers – Ms Teresa Cheng GBM GBS SC JP (Co-Chairman of AAIL), Mr Ben Bury (General Counsel of Gammon Construction Limited), and Ms Yvonne Shek (Counsel of Clifford Chance).
