The Future of International Investment Dispute Resolution: The European Union’s Proposal for a Multilateral Investment Court and the Court of Justice of the European Union’s Recent Judgment in Achmea

The investor-State dispute resolution has been an area of common interest and concern. In a timely manner, Judge Christopher Vajda of the Court of Justice of EU was invited to expound on the origin and the development of arbitration pursuant to bilateral investment treaties as well as the EU’s proposal for a multilateral investment court to replace the current arbitration system. In considering the judgment of the Court of Justice of EU in the Achmea case, Case C-284/16, delivered on 6 March 2018, the talk addressed an array of issues concerning the clamour for the reform of the investor-State dispute resolution system and shed light upon the recent developments in this area seen from a European perspective in particular.
