Review of Investor-State Arbitral Awards by States Courts:
Recent French Decisions

With arbitration being a main approach to resolve investor-State disputes, recent years are seeing an increase in investor-State arbitral awards rendered by courts across different jurisdictions. Against this background, the webinar provided an insightful review on the subject matter from the perspectives of both France and Singapore. After a succinct introduction by Mr Adrian Lai as the moderator, Dr Jane Willems presented a comparative analysis juxtaposing ICSID arbitration with non-ICSID arbitration and delved into the grounds invoked to challenge the awards in ten recent French cases, highlighting a shift in the French court’s application of those grounds in handling investor-State arbitration. Then, echoing with the review from the French perspective, Ms Alessa Pang gave an analytical review of three prominent cases where investor-State arbitral awards were examined by Singaporean courts.
