Potential Contribution of Common Law in the Greater Bay Area

As China’s sole common law jurisdiction, Hong Kong enjoys a unique position and pivotal role in the development of the Greater Bay Area. This seminar, moderated by Professor Huang Jiefang, Secretary-General of AAIL, set out to look into Hong Kong’s contribution and impact in this regard, highlighting the strength of Hong Kong’s legal traditions and the importance of cross-border legal dialogue.

Mr José-Antonio Maurellet SC, Chairman of the Hong Kong Bar Association, discussed the robustness of Hong Kong’s common law traditions underpinned by judicial independence and global trust. He examined the challenges and opportunities presented by the coexistence of three legal systems within the Greater Bay Area and called for harmonised dispute resolution mechanisms.

Mr Roden Tong, President of The Law Society of Hong Kong, elaborated on Hong Kong’s legal advantages under ‘One Country, Two Systems’, including bilingual legal professionals and the Mainland and Hong Kong Closer Economic Partnership Arrangement. He also emphasised on the importance of distinguishing between solicitors and barristers, showcasing Hong Kong’s ability to nurture legal talents for cross-border initiatives.

The hybrid seminar concluded with a consensus on leveraging Hong Kong’s common law system to enhance the integration of the Greater Bay Area as a global hub for commerce and legal innovation.
