Introduction to Investment Law and Dispute Resolution

Led by Dr Jane Willems, Associate Professor at the School of Law of Tsinghua University, and Mr David Branson, a leading international arbitrator, this workshop furnished the audience with concise and informative introduction of the main features of international investment agreements and arbitration. Dr Willems first discussed the Vienna Convention and different sources of international investment law, particularly delving into the application and jurisdiction of the ICSID Convention and bilateral investment treaties. Following from that, the talk explored in detail different types of substantive investment treaty obligations, in terms of both general standard of treatment and specific standard of treatment respectively. After specifically focusing on the concepts of fair and equitable trade, full protection security, expropriation, the drafting of treaties, such as North American Free Trade Agreement and Energy Charter Treaty, the scope of international treaties, and the most-favoured-nation treatment, it concluded with a discussion on the ICSID Convention, other international investment dispute resolution mechanisms, and a moot case study.
